 Did you know that Rule 104.16 defines and establishes concepts on matters of family relationships?

Rule 104.16

§         Defines a relative of a staff member as spouse, son or daughter, stepson or stepdaughter, father or mother, stepfather or stepmother, brother or sister, half brother or half sister, stepbrother or stepsister, uncle or aunt, nephew or niece, first cousin, father- or mother-in-law, son- or daughter-in-law, or brother- or sister-in-law.

§         Establishes that no relative of a staff member or of a representative assigned to the Permanent Mission of an OAS Member State to the OAS in Washington, D.C., may be appointed to the staff of the General Secretariat.

§         Clarifies that if two staff members get married while employed at the OAS they may remain as staff members, and their benefits and entitlements shall be modified to conform to the pertinent provisions of these Rules and other administrative issuances of the General Secretariat. Efforts shall be made to see that they do not work in the same department after the date of their marriage. 

§         Establishes that staff members who become relatives by way of marriage after joining the staff of the General Secretariat or otherwise, shall not be assigned to serve in a post which is superior or subordinate in the line of authority to the staff member to whom he/she is related and shall disqualify himself/herself from participating in the process of reaching or reviewing an administrative decision affecting the interests of that staff member.

§         Establishes that, if as a result of marriage a staff member becomes a relative of another staff member as defined in this Rule, the new relative and the staff member may all remain as staff members.
